If your backup device is on a different machine on your network than your SQL Server, I suspect a transient network problem.

I believe that if the problem were that another process was currently using the file, the error message would include "Operating system error = 32(The process cannot access the file because it is being used by another process.)".

Beware that 'WITH FORMAT' will overwrite any existing backup sets in the same file.
